FACTFILE

Tuesday 1st February 2011, 11pm. Reamonn Gormley was walking home with his friend David McFall after watching a football match in a local pub.

Daryn Maxwell and friend Barry Smith left a flat and decided to "Go rob someone".

They approached Gormley and McFall and a fight broke out after Gormley refused to hand anything over. Maxwell threatened Gormley with a knife and Smith showed a chisel to Mr McFall.

Maxwell then stabbed Mr Gormley three times in the neck and body.

The stab wounds to Mr Gormley's neck cut his carotid artery resulting in extensive blood loss.

Gormley was rushed to Hairmyres Hospital, in East Kilbride, where he was pronounced dead on arrival.

Monday 7th February 2011, Maxwell and Smith appeared at Hamilton Sheriff Court charged with murder.

Friday 3rd June 20011, Maxwell pleaded guilty to 'culpable Homicide" at Glasgow High Court.  The crown rejected his plea to culpable homicide, he was therefore kept on remand to appear on a murder charge. Co-accused Barry Smith pleased not guilty to murder.

Monday 10th October 2011, Smith changed his pleas from not guilty, to guilty of 'Culpable Homicide''. While Maxwell pleaded guilty to murder.

the court heard that both Maxwell and Smith were on bail at the time of the attack. At the time of the attack, Maxwell was on bail having been convicted and sentenced to 32 months for stabbing someone three times with a knife.

The court were read out a long list of Maxwell's previous convictions. These included at least two serious assaults, possession of an offensive weapon, breach of the peace and a number of breach of bail offences.

Sentencing was delayed because social work reports had not been available

Wednesday 5th December 2011, at The High Court in Perth, Judge Lady Dorrian sentenced Maxwell to life imprisonment, saying he must serve a minimum 19 years.

Barry Smith was detained for eight years and three months.
